Included (Purchase – $1,590.00): Legal fees, unlimited communications with lawyer and real-estate clerks until your purchase is closed, preparation and registration of deed, Sheriff’s searches for up to 2 vendors and 2 purchasers, Teranet fees, Unity transaction fees*, preparation and registration of first mortgage from primary lender (major Canadian bank or credit union), title search, review of condominium status certificate, required municipal/provincial government search fees, administrative disbursements, postage and courier fees, overhead costs, internal bank fees, photocopy costs, third party conveyance title and other search or closing fees, any other costs and disbursements that are not permitted Law Society of Ontario disbursements, and PST/HST on all of the above. The above is intended to represent all fees and disbursements included on a standard Essex County single family house (add: $100 for new-build and $200.00 for complete duplex) purchase transaction, and in most cases represents the final amount you will pay, plus Title Insurance and Land Transfer Tax.

Not Included (Purchase): Land Transfer Tax and Title Insurance (we apply all available title insurance rebates, discounts, and counsel fees directly to your bill, to reduce your cost of title insurance). *First-time home buyers may be eligible for a Land Transfer Tax rebate.

  • Some purchase transactions may require various additional fees and disbursements to complete your purchase properly. Additional fees and disbursements will be incurred on a Residential Real Estate purchase transaction for any of the following irregular situations/steps: Registrations beyond one deed or mortgage, survey ordering/review, off-title searches not required for title insurance, the cost of a condominium status certificate, mortgage insurance fees/taxes, payment for letters from creditors’ lawyers regarding similar name executions, use of secondary (non-bank) lenders, use of private lenders, mortgage guarantors, assumption/eviction of tenants, bridge financing, similar name executions, moving of closing date at your request, properties not fully registered with Land Titles, solar panel contracts, review and/or amendment of agreements of purchase and sale, properties located outside of Essex County, split signing appointments, out-of-office signing appointments, pre/post-closing payout of debts if required by lender, postponement or deletion of security interests, more than 2 individuals selling or purchasing, estate sales, powers of attorney, amendments to the agreement of purchase and sale (including name changes), postponements, PIN corrections, survivorship applications, any fees charged to you by a lender, broker, or agent and collected by our office, plus applicable PST/HST on all of the above.

The above is intended to represent all fees and disbursements included on a standard Essex County single family house (add: $200.00 for complete duplex) sale transaction, and in most cases represents the final amount you will pay, plus the cost of ordering a tax certificate if required.

Not Included (Sale): Cost of ordering/obtaining municipal tax certificate (varies by municipality – disbursement only), additional document registration required to close your deal, and the cost of discharging your first mortgage where discharge fee is not covered by your lender (it usually is). If you provide current and valid municipal tax information ten (10) clear business days prior to closing, we may not be required to order a tax certificate on your behalf.

  • Some sale transactions may require various additional fees and disbursements to complete your sale properly. Additional fees and disbursements will be incurred on a Residential Real Estate sale transaction for any of the following irregular situations/steps: Discharge beyond one mortgage, survey ordering/review, responding to off-title searches as may be requisitioned by the purchaser, the cost of a condominium status certificate, payment for letters from creditors’ lawyers regarding similar name executions, discharge of secondary (non-bank) lenders, discharge of private lender mortgages,  transfer/eviction of tenants, bridge financing, similar name executions, moving of closing date at your request, properties not fully registered with Land Titles, solar panel contracts, review and/or amendment of agreements of purchase and sale, properties located outside of Essex County, split signing appointments, out-of-office signing appointments, pre/post-closing payout of debts if required by lender, more than 2 individuals selling or purchasing, estate sales,liens or judgments on title or individuals, security interests/notices on title, powers of attorney, amendments to the agreement of purchase and sale (including name changes), sale by non-residents of Canada, mobile homes, postponements, PIN corrections, survivorship applications, any courier fees for charges beyond the first mortgage, any fees charged to you by a lender, broker, or agent and collected by our office, plus applicable PST/HST on all of the above.

Included (Refinance – $1,390.00): Legal fees, preparation and registration of first mortgage from primary lender, preparation and registration of discharge of one existing mortgage from primary lender (major Canadian bank or credit union), Sheriff’s searches for up to 2 owners, Teranet fees, Unity transaction fees*, title search, review of condominium status certificate, required municipal/provincial government search fees, administrative disbursements, postage and courier fees, overhead costs, internal bank fees, photocopy costs, third party conveyance title and other search or closing fees, any other costs and disbursements that are not permitted Law Society of Ontario disbursements, and PST/HST on all of the above. The above is intended to represent all fees and disbursements included on a standard Essex County single family house (add: $50.00 for condo, $100 for new-build, and $150.00 for duplex) refinance transaction, and in most cases represents the final amount you will pay, plus Title Insurance and the cost of ordering a tax certificate if required.

Applies to: Legal services provided by Michael Wills for residential single-family dwelling or condominium in Essex County Ontario on city services, and registered in Land Titles system (nearly all Ontario properties have now been converted into the Land Titles system), with vacant possession on closing and a single first mortgage from a primary lender (major Canadian bank or credit union), using First Canadian Title or comparable title insurance. Our rates are valid if you retain our firm and provide documents not later than five (5) business days before the closing date. Our rates are not valid for duplexes, multi-unit dwellings, commercial use, rental properties, investment properties, or any other matter outside of the scope of a standard residential real estate transaction using a primary lender.

Licensed Ontario lawyers Michael Wills of the McTague Law Firm LLP will perform all legal work on residential real estate transactions quoted above, assisted by our trained real estate clerks, associate lawyers, and support staff. We will honour any quote provided within 30 days of the date we provided the quote and prior to 5 business days before the closing date. The goal of this page is to set out the residential real estate fees of Mr. Wills as clearly as possible, and in the best interests of the public consistent with a high standard of professionalism.
